CALIFORNIA PROPOSITION 65 – LEAD CRYSTAL PRODUCTS

Dear Retailer,
As you know, California has a unique legal standard known as Proposition 65, which requires persons and/or entities to warn California consumers if their products would result in exposure to lead at a level greater than 0.5 micrograms (i.e., one-half of one, one-millionth ofa gram) per day. Under this standard, lead crystal products, including Lenox, Kate Spade, Reed & Barton and Gorham lead crystal products, require the California Proposition 65 Warning. Enclosed is a detailed memorandum from the International Crystal Federation ("ICF") with instructions on how to warn for lead crystal products.
If you have store locations in California, you are required to post Proposition 65 Warning Signs in the form set forth in the enclosed materials. Please pay close attention to the enclosed instructions. We have been advised by the ICF that enforcement activity by plaintiff "Bounty Hunter" lawyers has increased markedly over the past yean In this regard, we are advised that even the slightest deviation from the instructions could give rise to an action against your company by the Bounty Hunters.
If you ship products to California customers based upon a drop ship arrangement or catalog, internet and/or mail order sale of any kind, then you must comply with Proposition 65 Warning Instructions set forth in the enclosed memorandum. These instructions apply to businesses that sell to California customers and ship directly to the customer's California address — whether or not the business is located in California. Please note that the location of your business is irrelevant. If you ship to a customer in California, the warning must be provided.
Upon your request, Lenox will provide, free of charge, with the California Proposition 65
Warning Signs and materials required to meet your obligation under California law. To obtain
Proposition 65 materials, you may call a Lenox Customer Service associate at 1-800-971-7708. Customer Service will be able to provide you with Proposition 65 materials and answer any questions regarding how and where to post the Proposition 65 Warning Signs in your store.
